Why a percentage with a minimum?

Protection risk scales with order value, so 2% tracks it, while a minimum keeps small orders meaningful. A flat fixed fee also works if you prefer simple.

Can protection be opt-out instead of opt-in?

If your theme pre-checks the box, the attribute is set by default and customers untick to remove it. Check the consumer rules in your market before pre-checking.
